Important Announcement Regarding Employers' Liability (UK)

Ashdowns Limited (‘Ashdowns’) is an insurance company resident in the United Kingdom and regulated by the Financial Conduct Authority (‘FCA’). Ashdowns achieved authorisation to transact insurance within the UK to enable it to provide insurance capacity to the member companies of what was then the Pilkington Glass Group. It did this by way of:

- the direct insurance of member companies, and
- the reinsurance of third party insurance companies that provided insurance to the member companies.

Ashdowns commenced underwriting business on 1 April 1971* and ceased underwriting new business as at 1 April 1998. As a consequence it has been in ‘run-off’ since 1 April 1998 and all of its current insurance provisions relate to liabilities arising from policies that had expired on or prior to this date.

IMPORTANT ANNOUNCEMENT REGARDING EMPLOYERS' LIABILITY (UK)

Ashdowns has potential liability for policies under which UK commercial lines employers' liability cover has been provided to employers and which commenced on or after 1 April 1971 and ended on or before 1 April 1998.

Under FCA rules Ashdowns is required to make details of those policies available in an Employers Liability Register, which can be viewed by clicking on the link below. Enquiries may be made about any of the policies which Ashdowns were involved with by individual claimants, their authorised representatives, or insurers or their insurance intermediaries, with potential claims, by contacting Pilkington Group Legal department at :

* It should be noted that with effect from 1 April 1971 Ashdowns did not provide employers liability insurance; rather it provided an indemnity in respect of claim reimbursement provisions agreed with the insurers providing such statutory insurances.

Accordingly it did not provide ‘statutory’ insurance as required by UK law after this date; as this was purchased by Pilkington Group from recognised market insurers at the time. Ashdowns policyholder is Pilkington Brothers, the policies indemnified Pilkington Brothers for payments it is required to make to the statutory insurers under reimbursement arrangements with those insurers.
