These Terms and Conditions of Use apply to the use of Pilkington applications and its range of services accessible via this website that we, NSG, operate ("Website").
In these Terms and Conditions, "you" means the person and/or company using this website and its range of Services and "NSG" means Nippon Sheet Glass Co. Limited, Tokyo, Japan. By using this website, you agree to be bound by these Terms and Conditions. If you do not agree to any part of these Terms and Conditions, do not access or use this website. NSG may revise these Terms and Conditions at any time without notice. By using the Website, you agree to be bound by the then-current version of these Terms and Conditions.
NSG provides you with access to Pilkington applications ("Pilkington Applications") where you will be able to view and change the information we hold about you and your company, manage contact details and access a range of other services, including managing how your business appears on our Supplier Finder(s) website and reporting on user access to the same. Access and Available Services are added and changed from time to time. NSG is under no obligation to notify you of such updates.
NSG (1) gives you access to Pilkington Applications, (ii) allows you to access/modify the page dedicated to you on the Trade and/or Retails Supplier Finder service and or contact service the "Contact Pages) found on the website and (iii) notifies you that a consumer, claims specifier or other business has requested, that you contact them ("Services"). You must provide all equipment necessary to obtain Internet Access and pay all service and/or telephone charges associated with such access.
The Contact Pages are merely a meeting point where you can (i) provide your contact information, (ii) provide a brief description of yourself, (iii) display your logo, and (iv) include a few images related to you.
You acknowledge and agree that NSG accepts no responsibility or liability for the content, deletion or failure to store information, images or personal settings of your profile on Pilkington Applications or on the Contact Pages or on the website.
You acknowledge that NSG may establish general practices and limits on the use of the Services.
NSG reserves the right, at any time and from time to time, to (i) immediately, temporarily, or permanently withdraw your right to use the Services and/or (ii) temporarily or permanently modify or discontinue the Services (or any part thereof) with or without notice. You agree that NSG shall not be liable to you or any third party for any modification, suspension or interruption of the Services.
In exchange for your use of the Services, you agree to (a) provide true, accurate, current and complete information about your company and (b) maintain and promptly update such information so that it remains true, accurate, current and complete. If you (i) provide information that is untrue, inaccurate, misleading, not current or incomplete, or (ii) if NSG has reasonable grounds to suspect that such information is untrue, inaccurate, misleading, not current or incomplete, or (iii) provides information that violates applicable laws and regulations, then NSG has the right to suspend or terminate your access to Pilkington Applications and/or the Contact Pages and to deny you any current or future use of the Services.
You acknowledge that all of you are solely responsible for any information, data, text, photos, graphics, video, messages and other materials ("Content") contained or previously contained in your Contact Pages and/or Pilkington Applications, whether publicly or privately transmitted. This means that you, and not NSG, are solely responsible for all Content on your Contact Pages and Pilkington Applications. NSG does not control the Content posted on Pilkington Applications or your Contact Pages and therefore does not guarantee the accuracy, integrity or quality of such Content. You acknowledge that by using the Services and the Website, you may be exposed to Content that is offensive, indecent, or objectionable. In no event or in any way shall NSG be liable for Content, including but not limited to any errors or omissions in Content or any loss or damage whatsoever arising from the use of the Services or Content posted or otherwise transmitted through the Website or Services.
You will receive a password and login ID upon acceptance of these Terms and Conditions. You are responsible for keeping your password and login ID confidential and you must not disclose it to any third party. You are fully responsible for all activities performed with your password and login ID. You agree to notify NSG immediately of any unauthorized use of your password or login ID and any other breach of security. You further agree to indemnify NSG for any loss it may suffer through unauthorized use of your password and login ID and any other breach of security.
You agree that NSG may, in its sole discretion, terminate your password, login ID or use of the Services and remove and discard any Content in the Services for any reason, including but not limited to non-use or if NSG believes that you have violated or acted in violation of the letter and spirit of the Terms and Conditions. NSG may also, at its option and at any time, cease to provide the Services or any portion thereof with or without notice. You agree that termination of your access to the Services under any provision of these Terms and Conditions may be without prior notice and you acknowledge and agree that NSG may immediately disable or delete your access to Pilkington Applications and/or your Contact Pages and all related information. In addition, you agree that NSG shall not be liable to you or any third party for termination of your access to the Services.
You agree not to use the Services to:

Upload or otherwise transmit Content that is unlawful, harmful, threatening, abusive, harassing, scheming, slanderous, vulgar, lewd, libelous, violates the privacy of others, is hateful, or is objectionable by race, ethnicity or otherwise;
Forge headers or otherwise tamper with identifying information to disguise the origin of Content transmitted through the Services;
Upload or otherwise transmit Content that you do not have a right to send under law or contractual or trust-based relationships (e.g., inside information, own and confidential information learned or disclosed as part of an employment relationship or under confidentiality agreements);

Upload or otherwise transmit any unsolicited or unauthorized advertising, promotional materials, or any other form of solicitation;
Upload or otherwise transmit materials that contain software viruses or other computer code, files or programs designed to interrupt, damage, destroy or limit the functionality of any software or hardware or telecommunications equipment;
Interfere with normal dialogue, cause a screen to "scroll" faster than other users of the Services may type, or otherwise act in a manner that adversely affects other users' ability to engage in real-time exchanges;
Interfere with or interfere with the Services or servers or networks connected to the Services, or fail to comply with any requirements, procedures, policies or rules of networks connected to the Services;
Knowingly or unknowingly violate any applicable law or regulation, including but not limited to regulations issued by a stock exchange; or
"stalk" or otherwise harass.

You acknowledge that NSG has no obligation to monitor Content, that we disclaim all liability and liability arising from reliance on such Content by you, a third party or a person informed of the Content. NSG and its employees have the right, in their sole discretion, to refuse, move or remove any Content available through the Services that violates these Terms and Conditions or is otherwise objectionable. You agree to assess and bear all risks associated with the use of the Services, including any reliance on the accuracy, completeness or usefulness of such Content or Services.
You agree that NSG may access, preserve and disclose your account information and Content: (a) to its affiliates worldwide in order to provide the Services effectively to you; (b) to properly administer your account in accordance with NSG or its affiliates' standard procedures; (c) for marketing and promotional purposes to business customers and consumers; and (d) if required to do so by law or in the belief that such access, preservation or disclosure is reasonably necessary to: (1) comply with legal process, (ii) enforce the Terms and Conditions, (iii) respond to claims that Content infringes the rights of third parties, (iv) respond to your customer service requests, or (v) protect rights; property or personal safety of NSG, its users and the public.
You acknowledge that the technical processing and transmission of the Services, including your Content, may include transmission over various networks and modifications to meet and adapt to the technical requirements of connected networks or equipment.
You agree not to use an automated system or software to extract data from the Website and/or the Services. Any such use is strictly prohibited.
Recognizing the global nature of the Internet, you agree to comply with all local laws and regulations regarding online conduct and acceptable Content. You specifically agree to comply with all applicable laws regarding the transfer of technical data exported from the United Kingdom, the United States and your country of residence (if different from the above).
You agree to indemnify NSG and its subsidiaries, affiliates, officers, agents, co-branders and other partners and employees from any and all claims or demands, including without limitation reasonable attorneys' fees, made by any third party due to or arising out of the Content you submit, post or transmit through the Services, your use of the Services, your connection to the Services; your violation of these Terms and Conditions or your violation of law or the rights of a third party.
You agree not to reproduce, copy, copy, sell, resell or exploit for any commercial purpose any part of the Services, use of the Services or access to the Services.
The Website may contain links to other Internet pages or resources. Because NSG has no control over such sites and resources, you acknowledge and agree that NSG is not responsible for the availability of such external sites or resources and does not endorse or be responsible or liable for any information, advertisements, products or other materials contained on or available from such sites or resources. You further acknowledge and agree that NSG shall not be responsible or liable, directly or indirectly, for any damages or losses caused or alleged to be caused by or in connection with the use of or reliance on any such information, goods or Services available on or through such sites or resources.
You acknowledge and agree that the Services and any necessary software used in connection with the Services ("Software") contain proprietary and confidential information protected by applicable intellectual property and other laws. You further acknowledge and agree that Content in information presented to you through the Services or advertisers is protected by copyright, trademark, service mark, patent, and other rights and laws. Except with the express permission of NSG, you agree not to modify, rent, lease, loan, sell, distribute or create derivative works, in whole or in part, based on the Services or Software.
You acknowledge that NSG owns or licenses all intellectual property rights in the Website and the material published there. These works are protected by copyright laws and treaties worldwide. All such rights reserved. You acknowledge that any Content uploaded to Pilkington Applications and/or the Contact Pages and/or website is considered non-confidential and non-private and that NSG has an unlimited right to such information and that NSG may use such information in any manner at NSG's option. NSG may also disclose your identity to a third party who claims that Content on your Pilkington Applications and/or Contact Pages infringes their intellectual property rights or their right to privacy.
You expressly acknowledge and agree that:

Your use of the Services is solely at your own risk. The Services are provided on an "as is" and "as available" basis. To the fullest extent permitted by applicable law, NSG expressly disclaims all representations, warranties, conditions and other terms of any kind, express or implied, including but not limited to any implied terms of merchantability, satisfactory quality, fitness for a particular purpose and any terms regarding the provision of Services to a standard of reasonable care and skill or non-infringement of an intellectual property right.
NSG makes no warranty or promise that (i) the Services will meet your requirements, (ii) the Services will be uninterrupted, timely, secure, or error-free, (iii) the results that may be obtained from the use of the Services will be accurate or reliable, (iv) the quality of products, Services, information, or other materials purchased or obtained by you through the Services; will meet your expectations and (v) any errors in the Software will be corrected.
NSG grants the right to use the Services on a non-exclusive basis, that you acknowledge that other third parties will also be offered similar Services, regardless of their location.

Limitation of Liability: You expressly acknowledge and agree that, to the fullest extent permitted by law, NSG, its group companies and employees shall not be liable for any direct, indirect, incidental, special, consequential or punitive damages, including but not limited to damages due to lost profits, goodwill, use, data or other intangible losses (even if NSG has been advised of the possibility thereof); resulting from: (i) the use or inability to use the Services, (ii) the cost of obtaining substitute goods and services resulting from goods, data, information or services purchased or obtained, or messages received or transactions entered into through or based on the Services, (iii) unauthorized access to or alteration of your transmissions or Content; (iv) statements or conduct of a third party or (v) any other matter relating to the Services. This does not affect our liability for death or personal injury resulting from our negligence or any other liability that cannot be excluded or limited under applicable law. You agree that regardless of any statute or legislation with any other content, any claim or legal basis arising out of or relating to the use of the Services or these Terms and Conditions must be filed within one (1) year after such claim or legal basis arose, otherwise it will lapse.
The Japanese courts shall have exclusive jurisdiction over any claim arising out of or relating to these Terms and Conditions and the use of the Services. If you purchase or specify non-NSG products, you must contact the manufacturer of such products or conduct independent due diligence in relation to any technical issues.
Copyrights and Copyright Agents. NSG respects the intellectual property of others, and we ask you to do the same. If you believe that any of your intellectual property rights have been infringed on the Services, please contact NSG Customer Service to report the problem.
Live Chat Instant Messaging. Any information or guidance of a technical nature provided via Live Chat instant messaging service is only applicable to NSG/Pilkington products.
In the event that you purchase or specify non-NSG/Pilkington products, you are advised to contact the manufacturer of those products or conduct independent due diligence in relation to technical queries that you may have.
Please also check with your supplier that the NSG/Pilkington products are available in the sizes required and appropriate for satisfying all relevant local, regional, national and other project-specific requirements.
