What was the dispute with Uniglass about?

The dispute was in relation to Pilkington’s United Kingdom Registered Design No. 2090474.

What was the outcome of the dispute with Uniglass Ltd?

Without any admissions as to liability, Uniglass has undertaken not to sell or offer for sale, or import into the United Kingdom, goods which infringe UK Design Registration No. 2090474; this includes their Uni-Tor product. Uniglass has also agreed to withdraw from circulation and destroy all marketing literature in the UK that refers to such goods. Additionally, Uniglass has agreed to pay Pilkington UK a sum in damages and legal costs associated with this matter.

Why does Pilkington UK take this course of action?

We are determined to protect our intellectual property rights. Pilkington products are designed, manufactured and tested to the most exacting standards, for which an enormous investment has and continues to be made. In order to protect our interests and those of our bona fide customers, we will strenuously defend our products and brands.

What is the benefit to Pilkington UK of this sort of action?

We have always worked to develop the market in the UK & Ireland to add value to products for the benefit of the whole industry. This includes substantial investment in design and branding to both the consumer and trade customers and provision of sales literature, samples and other promotional devices. Both us and our customers benefit from this in terms of being asked for our products by name, in this case we expect that our product should be supplied. We invest in our designs and brands and like all brand owners we seek to maintain the reputation of these brands.

Why have you published this announcement in the glass press?

We are reminding the glass trade of our legitimate rights in our intellectual property.  We consider this to be a very serious issue and intend to protect our business and reputation so as to ensure our customers and consumers receive the product they are expecting.

Are you in legal disputes with other companies regarding your intellectual property?

This is a matter between Pilkington UK and the companies we identify.

What are you going to do about people who do not respect your rights?

We are prepared to take legal action against third parties in respect of any infringement of our intellectual property rights.

Will Pilkington UK continue to take this sort of action?

Yes, we will continue to investigate possible infringements of registered designs, trade marks and passing off and will issue further publicity to remind customers of the nature of our concerns.
